Tenancy deposit protection · UK

How long do I have to protect a tenant's deposit? Thirty days, and a record that proves it

A deposit has to be protected, and the prescribed information served, within 30 days of receiving it in England and Wales.

More

The part that decides a dispute is the record: the dates, the reference and proof the tenant was told.

Thirty days, from the day the money arrives

A deposit has to be protected, and the prescribed information served, within 30 days of receiving it in England and Wales.

One to three times the deposit

Getting it wrong can mean a court order to pay the tenant between one and three times the deposit.

No possession until it is right

A court will only give a possession order where the deposit was protected, returned, or a challenge has been resolved.

Protect it on day one

Pay it into the scheme the day the money arrives and record the scheme and the reference.

Serve the prescribed information

Give it to the tenant in writing and keep proof it reached them: the email, the signed copy, the date.

Keep the dates together

Received, protected, information served, on one record per tenancy, not scattered across an inbox.

The record to keep, per tenancy

A judge compares dates to the 30 days. Six items make a record that answers that, and they are the same ones a possession claim asks for.

  • Deposit amount, and the date it was received
  • Scheme used, and the deposit reference
  • Date it was protected (within 30 days of receipt)
  • Date the prescribed information was served, and how
  • The tenant's acknowledgement, if you have one
  • The scheme's certificate, saved with the tenancy

How much deposit you can take, by nation

The cap is a separate rule from the protection deadline, and it is not the same in any two nations.

NationCap on the deposit
England5 weeks' rent (annual rent under £50,000); 6 weeks' rent (£50,000 or more)
WalesNo statutory limit on the security deposit; holding deposit capped at one week's rent
Scotland2 months' rent
Northern Ireland1 month's rent

Penalty from the Housing Act 2004, s.214, read on legislation.gov.uk; the possession rule from the government's Renters' Rights Act overview for landlords, 1 May 2026. Schemes and deadlines are the ones the product applies for each nation. This is not legal advice.

LetBuddy tracks the protection deadline as a dated item and holds the scheme, reference and dates on the tenancy, with the certificate stored beside them. It does not protect the deposit for you; you pay it into the scheme.

Common questions

How long do I have to protect a deposit?

30 days from receiving it in England and Wales, 30 working days in Scotland and 28 days in Northern Ireland. The clock runs from the day the money arrives, not the day the tenancy starts.

What is the prescribed information?

The notice every tenant must be given within the same 30 days: the scheme and how it works, the deposit amount, how to get it back and what happens in a dispute, and the landlord's and tenant's contact details. Protecting the deposit and serving it are two separate duties, and landlords who did the first routinely cannot show the second.

What if I protected it late?

A tenant can apply to court for between one and three times the deposit, and a possession claim depends on the position being put right. Late protection does not stop being a problem once it is done; take advice from a housing solicitor.

Which schemes can I use?

One of the government-approved schemes for the nation the property is in. In England and Wales that is the DPS, MyDeposits or the TDS. Scotland and Northern Ireland have their own approved schemes, listed in the table above.

What should a deposit protection record contain?

The amount and the date it was received; the scheme and the deposit reference; the date it was protected; the date the prescribed information was served and how; the tenant's acknowledgement if you have one; and the scheme's certificate. Dates matter most: they are what a judge compares against the 30 days.

How much deposit can I take?

It depends on the nation. England: five weeks' rent where the annual rent is under £50,000, six weeks at £50,000 or more. Scotland: two months' rent. Northern Ireland: one month's rent. Wales: the Welsh Government has the power to set a limit on security deposits but has not used it, so there is no statutory cap on the deposit itself; a holding deposit in Wales is capped at one week's rent. A holding deposit is a separate payment with its own rules in every nation.
